Paternity Rights
Male employees are entitled to paternity leave in
California. Paternity leave is the time a father takes off work at the birth or
adoption of a child. Employers of 50 or more persons are generally required to
allow their employees (both men and women) who they have employed for more than
a year to 12 weeks of unpaid family leave after the birth or adoption of a
child under the Family and Medical Leave Act (FMLA). At the end of the leave,
the employer must allow the employee to return to his job or a similar job with
the same salary, benefits, working conditions, and seniority.
